ES WINDOWS, LLC ("ESW" or "we", "us", or "our") is committed to protecting the privacy of your Personal Information. This Privacy Policy (the “Policy”) applies to those ES websites that display or link to this Policy (referred to in this Policy as the "Website") and the functionalities and services provided by ES in connection with your use of the Website (“Services,” and collectively with the Website, “Platform”). It does not apply to those ES sites, services, and products that have their own privacy policies. This Policy describes the information we collect and how we use and disclose it. By visiting our Platform and using our services, you are accepting and consenting to the practices described in this Policy. If you do not consent, please do not use the Platform or the relevant services.
The Website and our Services may be operated, in whole or in part, from a country other than the United States. You consent to have your Personal Information transferred to and processed outside of the United States.
What information do we collect and store?
We may use a number of different techniques and technologies to collect Personal Information, Non-Identifying Information, and Usage Information. For example, we collect and store information that you provide to us, including through the Platform or our Customer Service Department or that we receive from third parties (such as companies providing commercially available databases).
1. Personal Information and Non-Identifying Information
We may ask you for personally identifiable information if, for example, you create an ES account or input certain information about yourself to the Platform in response to form questions or prompts. This refers to information about you that can be used to contact or identify you (“Personal Information”). We also collect other information that you provide as part of registration and the administration and personalization of your account with us that does not identify you (“Non-Identifying Information”). Non-Identifying Information includes, but is not limited to, your zip code (on its own), gender, and individual preferences. Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information (for example, your gender only or your viewing preferences).
For example, when you place an order, we may collect and store some or all the following information that you provide: name, billing address, shipping address, email address, telephone number, credit card number, and expiration date of such.
If you sign up for an ES account, we may ask for your name, e-mail address, date of birth, and password. If you select to be logged in persistently, basic profile information like e-mail, first name, last name, and a unique identifier for your account may be stored for up to 30 days in the browser that was used for the login. We may also collect the following additional information if you choose to provide it when you sign-up for an account: telephone number, gender, personal preferences, social identifier if you choose to log in to your account via social media, and, age. If you choose to apply certain discount codes when making purchases, we may store the information associated with that code – which may include, for example, a school or veteran status, and connect that information with your profile. We may collect your e-mail addresses and zip code if you subscribe to our newsletter, and we may collect your mobile number if you opt-in to receive text messages. You may unsubscribe at any time by following the instructions located within each newsletter or linked to each text message. Registration may be required, and Personal Information collected in certain areas of the Platform in which you specifically and knowingly provide such information, e.g., community postings (i.e., chat or bulletin boards), suggestions, or customer service requests.
Please note that if you submit any community postings or otherwise use any public communication feature offered through the Platform, any of the information that you share will be visible to other users. ES is not responsible for the manner in which any Personal Information that you decide to share will be used by other users.
2. Usage Information
When you access or use of our Platform, whether you are logged in or just browsing without logging in, we may also gather certain information about your use of our Platform that is sent automatically by your browser ("Usage Information"). Generally, this information is collected through "traffic data". We collect and store certain other information automatically whenever you interact with our Platform. For example, we collect your IP address, browser information, and reference site domain name every time you visit our Platform. We also collect information regarding customer traffic patterns and site usage.
Usage Information may be non-identifying or it may be associated with you. Whenever we associate Usage Data with Personal Information, we will treat it as Personal Information.
How do we use cookies, advertising, and online tracking?
Like many websites, we use "cookies", files sent to and stored on your computer's hard drive by your browser to identify account holders and to optimize their shopping experience. Cookies also allow us to hold selections in a shopping cart when a user leaves this Platform without checking out and send you reminder e-mails about your shopping orders and other shopping opportunities. Most browsers accept cookies automatically but allow you to disable them. We recommend that you leave cookies "turned on" so that we can offer you a better shopping experience. Certain features on the Platform will not be available to you if cookies are disabled.
Some web browsers may be configured to send “do not track” signals to websites, or users may use similar mechanisms, to indicate a user’s preference that certain web technologies not be used to track the user’s online activity. At this time, we do not respond to “do not track” signals or similar mechanisms sent by web browsers.
What about advertising?
We also use third-party companies to measure and target ads on our behalf about products and services tailored to your interests. We allow these third-party companies to use cookies (that send data to the third-party companies for their commercial use), web beacons, pixel tags, and similar technologies to collect or receive information about your interaction with us on our Platform and also track your activity elsewhere on the internet (“Tracking Data”) and use such Tracking Data to display ads for ES and other companies when you visit this or other websites.
Is information collected from children?
ES does not sell products for purchase by children. We do not knowingly collect or solicit Personal Information from children under the age of 13.
Users must be at least 13 years of age to access and use the Platform and, by using the Platform, you represent and warrant that you are 13 years of age or older and that you agree to and agree to abide by all of the terms and conditions of the Policy. Any access to or use of the Platform by anyone under the age of 13 is unauthorized, unlicensed, and in violation of this Policy. If ES believes that you are under the age of 13, ES may, at any time, in its sole discretion, and with or without notice: (i) terminate your access to or use of the Platform (or any portion, aspect, or feature of them), or (ii) delete any content or information that you have posted through the Platform.
How do we use your Personal Information?
We may use your Personal Information (in some cases, in conjunction with your Non-Identifying Information) to provide the products and services that you have ordered or requested, to process and ship orders, to provide customer service, to provide other services to you, to detect fraudulent activities, and to personalize the Platform, our communications with you, and your shopping experience. For example, when you create an ES account, you can use your account details to log in from any location and on any device. The global single sign-on for your account will allow ES systems to identify you wherever you are, so you will not need to register with us again if you sign in from a different country. In addition, if you select to be logged in persistently, we will store your basic profile information like e-mail, first name, last name, and, a unique identifier for up to 30 days in the browser that was used for the login.
We may also use your information to contact you with marketing or promotional materials and other information that may be of interest to you, such as sales, new products, new site features, special offers, and personalized offers based on your location, unless you have opted to not receive promotional communications.
We may also combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other users to attempt to provide you with a better experience, to improve the quality and value of the Platform, and to analyze and understand how the Platform is used. The information we collect may also be combined with information obtained from ES affiliates and from other companies. We may also combine this information with other information we collect as you interact with our social media and the marketing messages, we send you. For example, aggregating data allows ES to update and correct the information contained in our database and to provide you with product recommendations and special offers.
How do we use Usage Information?
We may use Usage Information to analyze and improve our Platform, to provide our customers with a fulfilling shopping experience, and to personalize the Platform, our communications with you, and your shopping experience. For example, we may use Usage Information to help us determine how people use parts of the Platform and who our readers are. This allows us to improve our Platform and ensure that it is as appealing as we can make it for as many people as possible. We may also use Usage Information to detect fraud and to provide statistical "ratings" information in aggregated form to our partners and other third parties about how our users collectively use the Platform. How do we share your Information?
ES’ policy is not to share your Personal Information with any company that is not ES or its affiliates other than as described in this Policy or where your consent has been provided. We may share your information, including Personal Information, with third parties under the following circumstances:
When you create an ES account, we will share some of your account details (such as your name, email address, password and date of birth) with other ES affiliates so you can have a global single sign-on for your account that will allow ES systems to identify you wherever you are in the world. We may also share your Personal Information with other ES affiliates if both entities are responsible for your Personal Information, or if the other entities are acting as our service providers and processing your Personal Information on our instructions or on our behalf.
We may hire other companies to provide services on our behalf, such as marketing, analytics, credit card processing, shipping, stocking orders, providing customer service, and fraud protection. These service providers have access only to such Personal Information appropriate to perform their functions and are contractually obligated to maintain the confidentiality and security of your information. They are restricted from using, selling, distributing or, altering this data in any way other than to provide the requested services. For example, we will share some of your account details (such as your name, email address, password and date of birth) with our cloud service providers for the purposes of identification and authentication, so you can quickly and efficiently sign-on to your ES account from anywhere in the world. We also share your purchase details, website usage data, payment information and other relevant data with our fraud prevention service providers.
We may access or disclose information about you, including the content of your communications, in order to: (a) comply with the law or respond to lawful requests or legal processes; (b) protect the rights or property of ES or our customers, including the enforcement of our agreements or policies governing your use of our Website and Services; or (c) act on a good faith belief that such access or disclosure is necessary to protect the personal safety of ES employees, customers or the public.
We may disclose Personal Information as part of a corporate transaction such as a merger or sale of assets.
What steps are taken to help secure Personal Information?
We use administrative, physical, and electronic measures designed to protect your information from unauthorized access. For example, we use commercially reasonable security measures such as encryption and firewalls to protect User information. Most browsers will give a visual indication of when your connection is secure. However, no data transferred over the Internet is guaranteed to be 100% secure. Accordingly, we do not guarantee the security of our databases, nor that information you supply won't be intercepted while being transmitted to us over the Internet or other network. Any information you transmit to ES , you do at your own risk.
If you set up an account through our Platform, you will be asked to provide an e-mail address and password. In order to help protect your Personal Information, you should be careful about providing your password to others. If you wish to cancel your account, or if you become aware of any loss, theft, or unauthorized use of your password, please contact our Customer Service Department.
What happens when I link to or from another website?
Our Platform may contain links to other websites. Our Policy does not apply to the practices of other websites and ES is not responsible for the actions and privacy policies of third parties. We encourage you to be aware of when you leave our Platform and to read the privacy policies of each website that you visit.
How do I opt-out of receiving promotions?
We provide you with several opportunities to opt-out of receiving our promotional communications and newsletters, including when you set up an account; by clicking on "Manage Your Account" on the Platform; and by following the "unsubscribe," "preference center," or other opt-out instructions contained in our promotional communications.

How does this policy apply to International Users?
If you choose to provide ES with your information, you consent to the transfer and storage of that information on our servers located in the United States and around the world. The Platform that links to this Policy is intended for users in the United States. Other countries may have laws and regulatory requirements that differ from those in the United States. Unless expressly stated to the contrary, ES makes no representation that the Platform, or the information contained on the Platform, is appropriate or will be available for use in other locations. ES reserves the right to limit, in its sole discretion, the provision and quantity of any feature, product, or service to any person or geographic area. Any offer for any feature, product, or service made on or through the Platform is void where prohibited. If you access or use the Platform from outside the United States, you are entirely responsible for compliance with applicable local laws and other applicable laws. You may not use any portion of the Platform in violation of applicable export laws and regulations.
If you access our Platform from outside the United States, you acknowledge and agree that your information may be transferred to and maintained on computers and servers in the United States where data protection and privacy laws may be different from and may not be as protective as the laws of your country. By using our Platform, you consent to the collection, transfer and use of your Personal Information in accordance with this Policy and the laws of the United States.
Changes to This Online Privacy Policy
We will update this Policy as needed to reflect changes in our services and customer feedback. When we post changes to this Policy, we will revise the version and date at the top. If there are material changes to this Policy or in how ES will use your Personal Information, we will notify you by posting a notice of such changes on the Platform prior to implementing the change.
